Definitions

"Massimo Skills Lab", "we", "us", and "the business" refer to Massimo Skills Lab operated by Massimo Spinella , a sole trader based in Cyprus.

"User" refers to anyone using the services of Massimo Skills Lab, including students, parents, or organizations.

"Tutor" refers to any individual providing tutoring, mentorship, or consultation through Massimo Skills Lab, including Massimo Spinella and any tutor appointed to handle work.

"Student" refers to the recipient of tutoring services or the person/organization responsible for payment.

"Project" refers to the tutoring arrangement between the Tutor and the Student, administered through Massimo Skills Lab.

"Session" refers to a single instance of tutoring, whether in person or online, regardless of its duration.

"Platform" refers to the website, communication, and payment system provided by Massimo Skills Lab.
Governing Law
These Terms and any disputes, controversies, proceedings, or claims arising out of or in any way related to these Terms or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Cyprus. The courts of Cyprus shall have exclusive jurisdiction over any disputes or claims arising out of or in connection with the use of our services.
Introduction
Massimo Skills Lab provides tutoring services, primarily through [Your Full Name], who may, at times, delegate work to other qualified tutors when required. Massimo Skills Lab facilitates tutoring arrangements and offers administrative and communication support. Massimo Skills Lab does not employ tutors but operates as a facilitator. Tutors are independent contractors responsible for their own contracts and services, and any agreement between the Tutor and the Student is a private arrangement between them.
Acceptance of Terms
By using Massimo Skills Lab’s services, you agree to these Terms and Conditions. It is understood that we cannot guarantee any specific academic outcome, such as grades or qualifications. The role of the tutor is advisory, and the responsibility for the student’s academic work rests solely with the student.
Using our services also implies acceptance of our Privacy Policy.
Delegation of Tutoring Work
While [Your Full Name] may serve as the primary tutor for most projects, in cases where they are unable to handle a project directly, Massimo Skills Lab may assign another qualified tutor. In such cases:

Eligibility

Users must be 18 years or older to use our services. Students under 18 must use the services under the supervision of a parent, legal guardian, or teacher.

If a student is under 18, the bill-paying account must be held by a person of legal age.
Unethical Practices
Massimo Skills Lab does not condone academic misconduct, including plagiarism or cheating. We reserve the right to immediately terminate services to any user involved in unethical practices. No refunds will be given if services are withdrawn for such reasons.
Non-Discrimination Policy
Massimo Skills Lab selects its clients based on their ability and need for services, without discrimination based on race, gender, religion, or any other protected characteristic. If you feel you have been unfairly treated, you may contact info@massimoskillslab.com.
Charges for Tutoring

Hourly rates for tutoring services will be agreed upon between the student and Massimo Skills Lab before services commence.

In cases where another tutor is delegated, the hourly rate will either remain the same or be renegotiated, with the Student’s approval.

Additional charges may apply for work outside regular sessions (e.g., reviewing written work). Any extra time or costs must be discussed and agreed upon in advance.

Payment is processed after each session or in batches, depending on the arrangement agreed upon by both parties.
Cancellation Policy:

Cancellations or rescheduling must be made at least 24 hours in advance. If less than 24 hours’ notice is given, the tutor may charge for 50% of the session fee.

If a student fails to attend a session without giving at least 2 hours notice, the full session fee may be charged.
Massimo Skills Lab Service Fees
Fees for the administrative services provided by Massimo Skills Lab (e.g., connecting students and tutors, and managing the platform) will be clearly explained before any engagement. These fees may be included in the overall cost of the tutoring service.
Billing and Payment

Invoices will be generated automatically after the session or as agreed.

Payments are to be made via debit/credit card or other approved methods through our secure payment provider.

By using our services, you agree to our automatic billing process, and payment will be attempted within three days after the session or as otherwise agreed.
Refunds

Any refund requests related to tutoring services should be directed to the tutor. If a tutor agrees to a refund, any related administrative fees charged by Massimo Skills Lab will also be refunded.

Refunds will only be made to the original payment method. If that method is no longer valid, alternative arrangements (such as bank transfer) will need to be made.
Termination of Services
Either party may terminate the tutoring arrangement at any time. However, any scheduled sessions should be cancelled in advance according to the Cancellation Policy.
Support Packages
For students opting into larger support packages:

Packages are prepaid blocks of hours with a tutor and must be used within a six-month period unless otherwise agreed.

Payment for the support package is typically divided into two installments: 50% upfront and the remainder as hours are used.
No refunds will be issued for unused hours after the agreed-upon period.
Liability and Academic Outcome
Massimo Skills Lab and its tutors do not guarantee any particular academic result, including exam grades, coursework success, or acceptance into specific programs. Responsibility for academic success remains with the student, and no claims can be made against Massimo Skills Lab for failure to achieve specific outcomes.
Confidentiality
All personal information provided by users will be treated as confidential and will not be shared with third parties, except as required by law or necessary to provide the agreed services. For details, please refer to our Privacy Policy.
Non-Solicitation
Users (both students and tutors) agree not to enter into private arrangements with any user introduced to them by Massimo Skills Lab for a period of six months after the conclusion of the engagement. This protects Massimo Skills Lab’s business interests.
Tutor Status
Tutors engaged through Massimo Skills Lab are independent contractors and not employees of the business. Tutors are responsible for managing their own schedules, locations, and teaching methods.
In cases where Massimo Skills Lab appoints another tutor to handle a project, Massimo Skills Lab remains responsible for the administration and oversight of the tutoring arrangement.
Tax
Tutors are responsible for handling their own taxes as independent contractors. Massimo Skills Lab’s fees are subject to VAT, which will be clearly indicated on any invoices, if applicable.
Amendments
We reserve the right to modify these Terms from time to time. Users will be informed of any changes, and continued use of the services will indicate acceptance of the new Terms.
